Alcohol Sales Authorization:
TalkShopLive (TSL) permits licensed sellers of alcoholic beverages (“Sellers”) to sell alcoholic beverages on the TSL platform, subject to strict adherence to these terms and conditions. Sellers are solely responsible for compliance with all applicable federal, state, and local laws governing the sale, shipment, and delivery of alcohol in both the seller's jurisdiction and the buyer's jurisdiction. This includes, but is not limited to, holding all required licenses and permits. Alcohol sales approval requests will be reviewed within one to two business days.
Seller Responsibilities:
- Licensing: Sellers must possess and maintain all required liquor licenses in their home state and in the buyer’s state and have and maintain valid contracts with common carriers, where required by law, to sell and ship alcoholic beverages. Sellers shall provide copies of their licenses and any other requested documentation to TSL or its designated payment processor, Stripe, upon request, to verify eligibility to sell alcohol on TSL. Sellers must respond promptly to any requests from TSL or alcohol regulators to verify licensure and adherence to alcohol beverage compliance requirements and restrictions.
- State Availability and Restrictions: Alcohol purchases are only available for delivery within certain areas of the United States where legally permitted. Due to state-specific regulations concerning the sale and delivery of alcoholic beverages, we do not support alcohol purchases or delivery to the following states:
- Arizona
- Georgia
- Hawaii
- Indiana
- Kansas
- Michigan
- Ohio
- South Dakota
Furthermore, availability in other states is subject to local laws and licensing requirements, which may change without prior notice. It is your responsibility to ensure that you are legally permitted to purchase and receive alcohol in your delivery location.
- Age and ID Verification: Alcohol may only be sold to and purchased by individuals who are 21 years of age or older. Sellers, and any third-party shippers or delivery providers they utilize, are responsible for verifying the identity and age of buyers both at the time of purchase and the point of delivery, and for ensuring that the provision of alcohol is legally permitted.
- Order Acceptance: Sellers must affirmatively accept or reject all alcoholic beverage orders. TSL does not hold any licenses for the sale of alcohol and acts solely as a third-party platform provider, connecting buyers with sellers. TSL does not have the authority to accept or reject a buyer's alcoholic beverage order. A sale is not final until the Seller has accepted the buyer's order.
- Payment Processing: Upon acceptance of an alcoholic beverage order by the seller, Stripe will charge the buyer’s credit card and process the funds as required by law.
Delivery Requirements:
- Delivery Restrictions: To receive an alcohol delivery, a person 21 or older must be present to show valid ID and sign for the package. Alcohol cannot be left unattended or delivered without contact.
- Undeliverable Orders: Sellers must maintain a policy for charges on orders that cannot be delivered. This policy will apply in the event of an undeliverable order. Sellers must communicate their policy at the time of purchase.
